Historical Note

Probate records document a deceased person's property, accounts or notes owed to him and debts or bills owed by him. The administrator, often the widow, settled accounts before heirs could receive their shares. Sometimes personal inventories of the deceased person with the names of the purchasers of the items at a sale are included. Names of minor heirs are often shown because guardians needed to be appointed. When personal property was not adequate to pay debts, heirs had to be informed that real estate was to be sold. Subsequent marriages of the deceased are shown, as under Indiana law the widow is entitled to one third of her husband’s estate including land, so she often petitioned for her "dower". An accounting of the estate after vouchers were paid showed the amount in the hands of the administrator to be distributed. Sometimes heirs receiving shares were shown. In insolvent estates, there was nothing to distribute and creditors sometimes received nothing or a percentage owed them.

Court sessions were conducted in February, May, August and November. Estates often continued in courts for years. Usually only the date of the final settlement or last action is shown. First letters of the month plus the last two digits of the year denote the court term.
